The petitioner is apprehending his arrest in connection with Mandu (Kuju) P.S. Case No. 186/2014 corresponding to G.R. No. 1859/2014, the case registered under Sections 379,411 of the Indian Penal Code, u/s 30 (ii) of Coal Mines Act and u/s 33 of the Indian Forest Act.
Learned counsel for the petitioner submitted that although petitioner has been named in the FIR but neither he is owner of any coal company nor concerned with the seized coal. It is furthe submitted that the co-accused person namely, Subedar Mahto and Misirlal Mahto have been granted anticipatory bail by a Bench of this Court in A.B.A NO. 2239 of 2015.
Learned A.P.P opposed the prayer for bail.
Considering the fact and circumstances of the case, the above named petitioner is directed to surrender in the Court below within four weeks from the date of this order and in the event of his arrest or surrender, the Court below shall enlarge the above named petitioner, on bail, on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Ramgarh, in connection with Mandu (Kuju) P.S. Case No. 186/2014 corresponding to G.R. No. 1859/2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C., subject to the further condition that on the date of surrender petitioner shall deposit Rs.5,000/- in the court below.
The aforesaid deposit shall be subject to the final result of the case and the same will not prejudice the case of the petitioner.
