The petitioner is an accused in a case registered under Sections 25(1-b)A and 26 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the first information report. The alleged recovery of arms shown by the police is also concocted, as there is no sign of independent witness(s) in the seizure list. Even if the content of the first information report is taken to be true, there is a recovery of one country made pistol and three live cartridges from possession of the petitioner for which he has already remained in judicial custody since 12th May, 2016. Learned counsel for the State opposes the petitioner's prayer for bail.
Considering the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount, each, to the satisfaction of learned Judicial Magistrate, 1st Class, Palamau at Daltonganj, in connection with Chhattarpur P.S. Case No.46 of 2016, corresponding to G.R. No.796 of 2016.
