The petitioner is an accused in a case registered under Sections 25(1-b)a and 26 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged. He was apprehended in Bashistnagar P.S. Case No.7 of 2016, registered under Sections 147, 148, 149, 323, 341, 379 and 504 of the Indian Penal Code. In the said case, on the basis of his own confessional statement, a country made pistol was recovered from possession of the petitioner. In Bashistnagar P.S. Case No.7 of 2016, the petitioner has already been granted bail. So far as the present case is concerned, the petitioner is in judicial custody since 3rd October, 2016. Learned counsel for the State opposes the petitioner's prayer for bail.
Considering the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount, each, to the satisfaction of learned Sub Divisional Judicial Magistrate, Chatra, in connection with Pratappur P.S. Case No.65 of 2016, corresponding to G.R. No.1240 of 2016.
