The petitioner has been made an accused for the offence registered under Section 392 of the Indian Penal Code.
2. Learned counsel for the petitioner has submitted that the petitioner has been made an accused on the basis of his confessional statement which has no evidentiary value in the eye of law. That no incriminating article has been recovered from his possession and in similar circumstances co-accused namely, Vijay Mehta @ Kaushal Mehta has been granted bail in B.A. No.5147 of 2016 by order dated 13.07.2016 by a Bench of this Court.
3. Learned A.P.P has opposed the prayer for bail.
4. Heard. Considering the fact that in similar circumstances, co-accused has been granted bail accordingly, the petitioner is directed to be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Palamau at Daltonganj in connection with Sadar (Satbarwa O.P.) P.S. Case No.33 of 2016, corresponding to G.R. No.344 of 2016.
