The petitioner has been made an accused for the offence registered under Sections 413/ 414 of the Indian Penal Code.
2. Learned counsel for the petitioner has submitted that there is no material evidence on record to show that the petitioner is habitual in dealing with stolen motorcycles. It is submitted by the learned counsel that similarly situated co-accused namely, Tileshwar Singh has been granted bail vide order dated 23.06.2016 passed in B.A. No.5109 of 2016 by a Bench of this Court.
3. Learned A.P.P has not controverted the above submission.
4. Heard. Considering the fact that co-accused has been granted bail accordingly, the petitioner is directed to be enlarged on bail on his furnishing bail bond of Rs.10,000/(Rupees ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Hazaribagh in connection with Sadar P.S. Case No.203 of 2016, corresponding to G.R. No.525 of 2016.
