Tibhu Bhuiyan Vs The State Of Jharkhand

It has been submitted by the learned counsel for the petitioner that similarly situated co-accused against whom the allegations were general and omnibus in nature have already been granted bail by this Court in B. A. No. 5153 of 2016 and B. A. No. 5145 of 2016. It has further been submitted that the petitioner is in custody since 24.11.2015.

Learned A.P.P. although has opposed the prayer for bail but has admitted the fact that the similarly situated co-accused persons have already been granted bail by this Court.

In view of the aforesaid facts, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Palamau at Daltonganj, in connection with Sadar (Town) P. S. Case No. 74 of 2015 corresponding to G. R. Case No. 241 of 2015 (S. T. No. 70 of 2016).
