05 /05.04.2016: Heard Mr. Nagmani Tiwari, learned counsel for the petitioner and Mr. Mukesh Kumar, learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Jadugora P.S. Case No. 14 of 2013, corresponding to G.R. No. 73 of 2013, registered under section 147, 341, 342, 323, 353, 427, 504 of the Indian Penal Code.
It has been submitted by the learned counsel for the petitioner that save and except the presence of the petitioner no specific overt act has been alleged against the petitioner. It has been submitted that the same allegation has been alleged against other accused persons.
Learned A.P.P. appearing for the State has opposed the prayer for anticipatory bail.
It appears that the petitioner was one of the person who had abused the police force and had also assaulted them and prevented them from discharging their official duties.
In such circumstance, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail is hereby rejected.
