Heard the learned counsel for the petitioner and the learned counsel for the State .
Learned counsel for the petitioner submits that admittedly the victim lady committed suicide in her Maike and the allegation in the FIR are vague and omnibus and there is no specific allegation against the petitioner abeting the deceased to commit suicide. It is also submitted that from perusal of the FIR itself it would be clear that on the date of death, there was a talk on mobile phone between the victim lady and her husband after which she committed suicide and there is not even an iota of evidence to show that there was any abetment at the instance of the petitioner as a result of which she committed suicide.
Learned counsel for the State opposed the prayer but relying upon the case diary fairly submitted there is no evidence in the case diary to show the complicity of the petitioner in the alleged offence .
Having regard to the facts and circumstances of the case, the petitioner above named, in the event of his arrest or surrender before the court below within a period of two weeks positively from the date of this order, shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Hazaribagh, in connection with Bishnugarh P.S. Case 70 of 2015 ( GR No. 2247 of 2015), subject to the conditions laid down under section 438(2) Cr.P.C.
