09 /16.02.2016 Apprehending his arrest, the sole petitioner has moved this Court for grant of privilege of anticipatory bail in connection with Dumka (T) P.S. Case No. 84 of 2015 instituted under sections 420, 467,468, 471 and 120B of the Indian Penal Code.

Heard learned counsel appearing for the petitioner as well as learned Addl. PP for the State.

Learned counsel appearing for the petitioner submitted that the petitioner, who is a retired government employee, has not committed any offence as alleged and even though he was custodian of the document in question but there is no evidence on record to show that there was any manipulation in the record at the hands of the petitioner. It was also submitted that two of the coaccused have already been granted the privilege of anticipatory bail and even in the enquiry report, only the negligence has been shown on the part of the petitioner. Hence, the petitioner deserves to be released on bail.

Learned Addl. PP appearing for the State though opposed the prayer.

Considering the submissions of the counsels and the fact as discussed above, I am inclined to grant privileges of anticipatory bail to the sole petitioner. Hence, in the event of his arrest or surrender within a period of two weeks from the date of this order, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Dumka in connection with Dumka (T) P.S. Case No. 84 of 2015 (G. R. 435 of 2015 ) subject to the conditions laid down under section 438 (2) Cr. P.C.
