03/ 21.04.2016 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner has been made accused for the offences under Sections 323, 341, 376 / 34 of the Indian Penal Code, in connection with S.T. No. 202 of 2012, arising out of Basal P.S. Case No. 2 of 2012 corresponding to G.R. No. 435 of 2012.

There being direct allegation against the petitioner to have committed rape upon the minor daughter of the informant, the earlier bail applications of this petitioner were rejected twice on merits.

Learned counsel for the petitioner has renewed the prayer for bail submitting that only the I.O. has remained to be examined in the case.

Learned counsel for the State has opposed the prayer for bail.

In the facts of this case, I am not inclined to reconsider the prayer

for bail of the petitioner, Anil Munda. Accordingly, his prayer for bail is rejected.

¶9

The submission of learned counsel for the petitioner, if true, the Trial Court is shall take effective steps for procuring the attendance of the I.O. and conclude the trial expeditiously.
