3/ 11.04.2016 Heard learned counsel for the petitioner and learned A.P.P. for the Prosecution.

The petitioner has been made accused for the offence under Section 387 of the Indian Penal Code, in connection with Sadar (Town) P.S. Case No. 377 of 2012 corresponding to G.R. No. 1531 of 2012.

The case relates to demand of levy through mobile phone in the name of this petitioner. Earlier bail application of this petitioner was rejected on merits by order dated 13.7.2016 in B.A. No. 3946 of 2015.

Learned counsel for the petitioner has renewed the prayer for bail submitting that the mobile phone mentioned in the FIR, neither belongs to the petitioner, nor it was recovered from the petitioner.

Learned counsel for the State has opposed the prayer for bail, but upon going through the case diary, it is admitted that the said mobile phone belongs to another person and it was not recovered from the petitioner.

In the facts of this case, I am inclined to enlarge the petitioner, Bandhu Shukla @ Ajit Kumar Shukla, on bail. Accordingly, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Palamau, in connection with Sadar (Town) P.S. Case No. 377 of 2012 corresponding to G.R. No. 1531 of 2012.
