3/ 15.06.2015. Heard learned counsel for the petitioners and the learned counsel for the State.

The petitioners have been made accused in connection with Bandgaon P.S. Case No. 49 of 2013, corresponding to G.R. No. 474 of 2013, S.T. No. 128 of 2014, for the offence under Sections 364, 302, 201, 34 of the Indian Penal Code and Sections 3 / 4 of the Prevention of Witch (Daain) Practice Act.

There is allegation against the petitioners to have committed the murder of four persons. However, the impugned order shows that no dead body was recovered. The F.I.R. also shows that the informant is not the eye witness to the occurrence, rather she was only informed about the occurrence.

It is submitted that the witnesses examined so far have not made any allegation against the petitioners and the informant has turned hostile. Learned counsel for the petitioners has produced the certified copy of the deposition of the witnesses, let the same be kept on record.

In the facts of this case, I am inclined to release the petitioners on bail. Accordingly, the petitioners, Sukhram Singh & Devnath Singh, are directed to be released on bail, on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge- II, Chaibasa, in connection with, Bandgaon P.S. Case No. 49 of 2013, corresponding to G.R. No. 474 of 2013, S.T. No. 128 of 2014.
