It reveals that petitioner has been found cultivating poppy plant and cutting was also found on the plant for obtaining opium. Seeing the police party, the petitioner and his associates fled away but they were identified by the chowkidar who disclosed their names.

It is submitted that similarly situated two of the co-accused namely Uday Singh and Gautam Singh have been granted bail by a Bench of this Court vide B.A. No.3406 of 2015. Prayer for bail made on behalf of this petitioner was earlier rejected on 29.01.2015 vide B.A. No.8860 of 2014. None of the three witnesses examined during trial has identified the petitioner in Court.

Learned counsel appearing for the State has opposed the prayer for bail. Since two of the co-accused are enjoying privilege of bail, above named petitioner is also directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court of learned Spacial Judge NDPS -cum- 1^st Addl. District Judge, Latehar in connection with N.D.P.S. Case No.12 of 2009 with the condition that one of the bailor must be a local person having landed property and he shall produce his identity card at the time of furnishing bail bonds and the petitioner shall attend the Court positively in person on each date falling within next three months from the date of his release.
