The petitioner is an accused in connection with Namkom P.S. Case No. 247 of 2014, corresponding to G.R. No. 6683 of 2014, registered for the offence punishable under section 302 of the Indian Penal Code.
It has been submitted by the learned counsel for the petitioner that the petitioner has been falsely implicated in the present case and that the petitioner is in custody since 4.12.2014
Learned counsel for the State has opposed the prayer for bail and has submitted that the petitioner is named in the first information report and there is direct allegation of assault against the petitioner of committing murder of the deceased by means of Tangi, which has subsequently been recovered from the house of the petitioner.
Regard being had to the facts that there is direct allegation of assault against the petitioner of committing murder of the deceased by means of Tangi, which has subsequently been recovered from the house of the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for bail is rejected.
