2/16.07.2015 Heard learned counsel for the petitioner and learned counsel for the State. Petitioner has been made accused for the offence under Section 384 of the Indian Penal Code and Section 17 of the CLA Act, in connection with Murhu P.S. Case No.89 of 2014, corresponding to G.R. No.530 of 2014.
From the FIR, it appears that the house of the co-accused was raided from where incriminating articles were recovered. Petitioner is not named in the FIR.
The impugned order shows that the petitioner was apprehended in connection with another case and he confessed about his involvement in the present case also.
In the facts and circumstances of the case, I am inclined to release the petitioner on bail. Accordingly, the petitioner Ajay Prasad is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned SDJM, Khunti, in connection with Murhu P.S. Case No.89 of 2014, corresponding to G.R. No.530 of 2014.
