02/03.12.2015 Heard Mr. Ranjan Kumar Singh, learned counsel appearing for the petitioner and Mr. Vijay Kumar Roy, learned A.P.P. for the State.
Petitioner has prayed for grant of anticipatory bail, as he is apprehending his arrest in connection with Baliapur P.S. Case No. 131 of 2015 corresponding to G. R. No. 4328 of 2015 registered for the offences punishable under Section 379 of the Indian Penal Code read with Sections 54, 21 and 4(1-A) of the JLKSN Act, 2004 and Section 6 and 8 of KVVA Act pending in the court of learned Judicial Magistrate, Dhanbad.
It has been submitted by the learned counsel for the petitioner that the petitioner has been falsely implicated in the present case being the driver of the tractor.
Learned A.P.P., on the other hand, has opposed the prayer for bail.
It appears that the tractor was apprehended loaded with stone for which no documents could be produced and the petitioner happens to be the driver of the said tractor.
In such circumstance, I am not inclined to grant anticipatory bail to the petitioner which is, accordingly, rejected.
