Vikram Topno Alias Tenu Topno Vs The State Of Jharkhand

The petitioner has been made an accused in connection with Murhu P.S. Case No. 28 of 2013 registered under Sections 147/148/149/379/307/302 of the Indian Penal Code and under Section 27 of the Arms Act and 17 of the Criminal Law Amendment Act.

It has been submitted by the learned counsel for the petitioner that petitioner is not named in the first information report and subsequently one of the witnesses had developed the story and had implicated the petitioner in the present case. It has further been submitted that petitioner was not identified in the test identification parade and he is in custody since 10.6.2013.

Learned counsel for the State opposes the prayer for bail but does not dispute the aforesaid fact.

Regard being had to the above fact, the petitioner Vikram Topno @ Tenu Topno is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, 1^st Khunti in connection with Murhu P.S. Case No. 28 of 2013 corresponding to G.R No. 162 of 2013 ( S.T No. 913 of 2013).
