06/10.09.2015 Heard Mr. Amit Kumar Das, learned counsel appearing for the petitioner and Mr. Ashok Kumar No. 2, learned A.P.P. for the State assisted by Mr. Manoj Kumar Choubey, learned counsel appearing for the informant.

Petitioner has prayed for grant of anticipatory bail, as he is apprehending his arrest in connection with Adityapur P.S. Case No. 443 of 2014 corresponding to G. R. No. 1275 of 2014 registered for the offences punishable under Sections 498(A), 506, 341, 323, 406/34 of the Indian Penal Code and Section 3/ 4 of the Dowry Prohibition Act.

Pursuant to the order dated 20th August, 2015 a report has been received from JHALSA, Ranchi from which it appears that the parties have compromised the matter and it has been agreed that the first installment of Rs. 2,000,00/- out of Rs. 4,000,00/- will be paid by way of bank draft in the name of the opposite party no. 2 at the time of hearing of the present anticipatory bail application.

Mr. Amit Kumar Das, learned counsel appearing for the petitioner submits that the draft of Rs. 2,000,00/- is ready and the same is in his possession and the same has been prepared in the name of the opposite party no. 2 as Neelam Kumari Gupta @ Sahu but it has been intimated by the learned counsel for the informant that the account of the informant is maintained in the name of Neelam Kumari and in such circumstance, Mr. Amit Kumar Das, learned counsel appearing for the petitioner submits that he shall get a fresh draft prepared for an amount of Rs. 2,000,00/- and shall hand over to the same on the date of his surrender.

In view of the said facts, this application is allowed and the petitioner, named above, is directed to surrender in the court below within three weeks from today and on the date of his surrender if, he hands over the draft of Rs. 2,000,00/- to the opposite party No. 2, the petitioner shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Principal District & Sessions Judge, Seraikella, in connection with Adityapur P.S. Case No. 443 of 2014 corresponding to G. R. No. 1275 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
