Heard Mr. Sandip Kumar Burnwal, learned counsel, appearing for the petitioner and Mr. Ritesh Kumar, learned counsel, appearing for the opposite party No. 2.

Petitioner has prayed for grant of anticipatory bail, as he is apprehending his arrest in connection with P.C.R. Case No. 848 of 2014 (T.R. No. 1281 of 2015) registered for the offences punishable u/s 498A of the Indian Penal Code.

Earlier vide order dated 9.10.2015, the matter was referred to the Mediator, Godda and from the report of the Mediator which has been received by this Court, it appears that the parties have settled the dispute and in fact the petitioner has handed over the Stridhan to the opposite party No. 2. It further appears from the report of the Mediator that both the parties have agreed to settle the matrimonial dispute through process of mediation. The opposite party No. 2 has further agreed to cooperate with the first party member to resolve pending disputes.

Regard being had to the above fact, I am inclined to allow this application. Accordingly, the petitioner, named above, is directed to surrender in the court below within three weeks from today and on such surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Godda in connection with P.C.R. Case No. 848 of 2014 (T.R. No. 1281 of 2015), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
