02/08.05.2015. Bail petition filed by Vicky Kachchhap @ Domka @ Vicku Kachchhap, is moved by Mrs. Jashodhara Tripathi, learned counsel for the petitioner and opposed by Mr. Shekhar Sinha, A.P.P. for the State.
Earlier bail prayer of the petitioner rejected, because some stolen articles recovered from his possession. However, it appears that one of the seizure list witness Sanjiv Kumar has already been examined in the court below as P.W.1 but he has not supported the case of prosecution. It is submitted that another witness shown in the seizure list has not been named in the charge-sheet.
Considering the aforesaid facts and circumstances and also taking into account that petitioner is in custody from 18.02.2013, I allow this application and direct the court below to enlarge the petitioner on bail on his furnishing bail bond of Rs.10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of A. J. C-XII, Ranchi in connection with S.T. No. 95/2014.
