3/20.07.2015 Heard learned counsel for the petitioner and learned counsel for the State, as also learned counsel for the informant.

The petitioner has been made accused in connection with Sadar P.S case No. 54 of 2014 corresponding to G.R No.311 of 2014, S.T No.173 of 2014, for the offence under Sections 341, 342, 323, 504, 307, 34 & 302 of the Indian Penal Code.

There is allegation against these petitioners to have assaulted the family members of the informant, in which, one of them subsequently died.

Learned counsel for the petitioner has submitted that there is omnibus allegations against these petitioners to have assaulted three persons, even though the informant is an eyewitness to the occurrence. It is also submitted that the statement of the deceased was also recorded, while he was alive, but he had not stated as to who had assaulted him. Learned counsel has accordingly, prayed for bail.

Learned counsel for the State, as also learned counsel for the informant have opposed the prayer for bail.

It is apparent from the FIR as also from the statement of the deceased recorded in the case diary that there is only omnibus allegations against these petitioners.

In the facts and circumstances of the case, I am inclined to enlarge the petitioners, Suresh Singh, Jitendra Singh @ Chhotu Singh, Raju Singh and Arun Singh, on bail. Accordingly, the petitioners, named above, are directed to be released on bail, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-III, Chatra, in connection with Sadar P.S case No. 54 of 2014 corresponding to G.R No.311 of 2014, S.T No.173 of 2014.
