Ram Chandra Bedia Alias Om Prakash Bedia Vs The State Of Jharkhand

Heard learned counsel for the petitioners and learned counsel for the State. Petitioners have been made accused for the offence under Sections 302/201/34 of the Indian Penal Code, in connection with Giddi P.S. Case No.15 of 2014, corresponding to G.R. No.1084 of 2014.

The case relates to murder of the brother of the informant, whose dead body was recovered from a well. Petitioners are not named in the FIR.

Learned counsel for the petitioners has submitted that the petitioners have been falsely implicated in this case only on the basis of suspicion and there is no other material against the petitioners.

Learned counsel for the State though has opposed the prayer for bail, but it is submitted upon going through the case diary that there is only last seen evidence against the petitioners.

In the facts and circumstances of the case, I am inclined to release the petitioners on bail. Accordingly, the petitioners Sonwa Munda and Ram Chandra Bedia @ Om Prakash Bedia are directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of like amount each to the satisfaction of learned SDJM, Hazaribagh, in connection with Giddi P.S. Case No.15 of 2014, corresponding to G.R. No.1084 of 2014.
