05/ 20.07.2015 Heard learned counsel for the petitioner, learned A.P.P. for the State as also learned counsel for the informant.
The petitioner has been made accused for the offences under Sections 387, 452, 307, 411 34 of the Indian Penal Code, Section 27 of the Arms Act and Sections 3/4 of the SC/ST (POA) Act, in connection with Sadar (Town) P.S. Case No. 227 of 2014 corresponding to G.R. No. 1002 of 2014.
There is direct allegation against the petitioner to have demanded the cost of three pistols and one carbine from the informant as levy and due to non-fulfillment of the levy, to have taken away the van of the informant, loaded with gas cylinders and also to have made assaults by firearm on the house of the informant. The police had reached the place of occurrence and had recovered the looted gas cylinders from the house of this petitioner.
In the facts of the case, I am not inclined to release the petitioner, Anu Vishwakarma, on bail. Accordingly, his prayer for bail is rejected.
