Learned counsel for the petitioner submits that petitioner's C.M.P.F. amount has remained outstanding for the year 1972-74, though he has retired on 31.7.2004 from the post of Operator under Giddi Washery under the Respondent- C.C.L and his C.M.P.F account is D/424220.

According to the petitioner in the counter affidavit filed by the C.M.P.F, it has been stated that the relevant document has not been sent by the Office of the employer concerned. Petitioner has also represented before the respondent no. 4, the Project Officer, Giddi Washery, Central Coalfields Limited, Hazaribag,

Learned counsel for the respondent- CCL submits that petitioner's representation would be considered in accordance with law.

In view of the aforesaid statement made by the learned counsel for the respondent- CCL, the writ petition is disposed of without making any comment upon the merit of claim of the petitioner by allowing him liberty to approach the respondent no. 4, Project Officer, Giddi Washery, Central Coalfields Limited, Hazaribag for rederssal of his grievances by filing a fresh representation. On receipt of such representation of the petitioner, the respondent no. 4, Project Officer, Giddi Washery, Central Coalfields Limited, Hazaribag shall consider the same in accordance with law and if it is found that his claim are genuine and admissible, the same be forwarded to the office of respondent no. 5, The Regional Commissioner, Region-1, C.M.P.F., Mayfield, Station Road, Chutia, Ranchi within a period of 8 weeks, thereafter. On receipt of such documents, respondent no. 5, The Regional Commissioner, Region-1, C.M.P.F., Mayfield, Station Road, Chutia would consider the petitioner's claim and admissibility thereof and if amount are found to be payable, such amount be released in petitioner's favour,

thereafter, within a period of 4 weeks on receipt of such recommendation and

The writ petition is disposed of in the aforesaid manner.
