According to the petitioner, her husband had joined as Overseer on 31.01.1973, which designation was later on changed to Junior Engineer vide memo no. 4778 dated 20.03.1974. It is stated that the said re-designation of the post was not in the nature of a promotion as the petitioner's husband remained in the same pay scale in the same service condition. Her husband was drawing scale of Rs.5,000 – 8,000 under 5th Pay Revision and after his death, the petitioner's family pension was also fixed on the same scale and was being drawn as per P.P.O. No.- PTSMIR 036S issued by the Office of the Principal Accountant General, Jharkhand. However, according to the petitioner, her husband was entitled to grant of ACP in terms of the Finance Department Resolution dated 14.08.2002 with effect from due date i.e. 09.08.1999 for which the petitioner represented before the respondents, specially respondent no.6 - Executive Engineer, Minor Irrigation Division, Garhwa. Though, the recommendation has been made by the Executive Engineer for consideration of the petitioner's grievances, as per Annexure-9, to the Superintending Engineer, Minor Irrigation Circle, Medininagar but the same has not been redressed till date. The petitioner is entitled to the benefit of A.C.P. and any other consequential benefits in the post retirement dues.
