Petitioner through the medium of this petition, has invoked the supervisory jurisdiction of this Court, seeking a direction upon the court of learned Chief Judicial Magistrate, Sopore, to take up and decide the application filed under Section 151 CPC read with Order IX Rule 9 CPC, seeking restoration of his application under Order IX Rule 13 of CPC.

The learned counsel for the petitioner submits that the petitioner, who is aged more than seventy years, has been waiting for the progress in his application moved under Section 151 of CPC since 02.12.2025, and submits that the petitioner shall be satisfied in case the petition is disposed

of at this stage with the direction to the court below to move expeditiously in the matter.

Having regard to the pleadings and the submissions made by the learned counsel for the petitioner at the bar, the petition is disposed of at this stage with the request to the court below to expedite the hearing and disposal of the aforesaid application, preferably within a period of six weeks from the date of receipt of a copy of this order.

A copy of this order shall be forwarded to the court below for information and compliance.
