Mohd Iqbal and Others Vs U T of J and K Th SHO Poonch and Another

Petitioners through the medium of this petition filed under Section 482 of the Cr.P.C seek quashment of the challan being File No. 277 dated 27.08.2022 titled, “ UT of J&K Vs. Mohd. Iqbal & Ors. ” pending before the Court of learned Special Mobile Magistrate (Sub Judge), Poonch ( hereinafter referred to as the “ trial Court ”) for commission of offences punishable under Sections 451, 323, 147 and 506 IPC, arising out of the FIR No. 86/2022, registered with Police Station, Poonch.

Learned counsel for the petitioners submits that after investigation of the case, charge-sheet has been laid, however, no substantial proceedings have been carried out by the learned trial Court, so much so, even charge/discharge has not been considered so far. He has also submitted that the petitioners would feel satisfied, in case a direction is passed to the learned trial Court to proceed in the matter expeditiously.

On consideration of the pleadings, material on record and also the submissions made by the learned counsel for the petitioners at the Bar, this petition is disposed of with a direction to the Trial Court to proceed in the matter expeditiously and ensure not to delay the matter in its disposal on unnecessary submissions. The learned trial Court shall consider the charge and decide the matter with regard to it within a period of two months from the date of receipt of the certified copy of this order.

The petition is, accordingly, disposed of alongwith connected application.
