The petitioner has thrown challenge to the order dated 13.12.2021 passed by the court of Munsiff/Judicial Magistrate Kangan, in an application for interim relief.
Prima-facie , it appears that the order is appealable, as such, in presence of statutory remedy of appeal, the petition under Section 227 would not lie without availing the said remedy of appeal. Petition accordingly is sought to be withdrawn by the petitioner with liberty to invoke appropriate remedy of appeal.
Petition is dismissed as withdrawn with liberty as prayed for.
