Mr. Aditya Gupta states that the controversy involved in the present petition relates to an issue in respect whereof an appeal is provided and had infact been earlier filed by the petitioner before the State Electricity Regulatory Commission.
Mr. Gupta states the instant petition was filed due to the nonavailability of the Chairman and the Members of the Commission (supra).
Mr. Gupta further states that now the Appellate Authority is in place and the appeal of the petitioner is likely to be considered as such, Mr. Gupta prays for withdrawal of the petition. Permitted.
Writ petition is dismissed as withdrawn.
