By way of instant writ petition filed under Article 226 of the Constitution of India, petitioner has prayed for following main relief:

“(i) That appropriate writ, order and directions may kindly be issued thereby ordering and directing the respondents-authorities to issue the Degree of BBA as petitioner has already cleared all the semesters examination as required for BBA Course in favour of the petitioner immediately;

(ii) That the action on the part of the respondents is not sending the name of the petitioner to the HPERC be setright and Appropriate Directions be issued to send the name of the petitioner to HPERC for grant of Degree;

(iii) That the respondents/ committee may kindly be directed to reconsider the criteria set up for considering the genuine students on the basis of name available in both green list as well as in admission disclosed list.”

Learned counsel representing the respondents fairly state that Government of Himachal Pradesh has constituted a Committee in the matter of Manav Bharti University for the purpose of verification and for issuance of mark sheet and other documents and as such, petitioner can be asked to approach aforesaid authority for redressal of his grievance.

At this stage, learned counsel for the petitioner states that his client would be content and satisfied in case direction is issued to respondent No.2, Superintendent of Police, Solan, District Solan, H.P.cum- Chairman Document verification Committee, to decide the case of the petitioner, in a time bound manner.

Consequently, in view of the above, present petition is disposed of with a direction to respondent No.2 to decide the case of the petitioner, strictly in terms of communication dated 23.01.2023, whereby Himachal Pradesh Private Educational Institutions

Regulatory Commission, Shimla, has already directed aforesaid authority to examine the case of the students of Manav Bharti University for issuance of mark sheet/degrees etc, expeditiously, preferably within a period of four weeks. Needless to say, authority concerned while doing the needful in terms of the instant order, shall afford an opportunity of being heard to the petitioner and pass a speaking order thereupon. Liberty is reserved to the petitioner to file appropriate proceedings in appropriate court of law, if he still remains aggrieved.

Learned counsel for the petitioner undertakes to cause presence of the petitioner before the authority concerned within period of two weeks, enabling it to do the needful in terms of the instant order. Pending applications, if any, also stand disposed of.
