2. This writ petition has been filed for the grant of following substantive prayers:-

“I. That the Recruitment & Promotion rule formulated by respondent Himachal Pradesh Technical University for the post of Personal Assistant (Annexure P-5 dated 18.10.2014) to the extent of providing 11 years combined services as Steno-Typist/Junior Scale Stenographer for promotion to the post of Personal Assistant be declared illegal capricious and suffering from bias of manifest arbitrariness, Undue enrichment

by providing accelerated promotion to the category of ministerial staff.

II. Further respondent University be directed to make it in consonance with Recruitment & Promotion rules for the post of Personal Assistant, formulated by the Department of Personnel (Annexure P-6 dated 29.08.2022) and mutatis mutandisly made applicable to all the departments in state of Himachal Pradesh, by prescribing minimum 16 years of combined services on the post of Steno-Typist Junior scale stenographer.

III. Writ of prohibition be issued by restraining the respondent University from making promotions to the post of Personal Assistant which is equivalent to Superintendent Grade-II/Section officer and at this stage forms the common cadre with the Administrative staff till the final adjudication of the writ petition otherwise, it will minimize the right of promotion of petitioner from the post of Superintendent Grade-II.”

3. Petitioner’s grievance appears to be in relation to

the number of years of service required by the ministerial staff for their further promotion to the post of Personal Assistant. Petitioner was promoted to the post of Senior Assistant in the respondent-University in February, 2021. The case record shows that concerning his grievances, petitioner has preferred a representation to the respondent on 28.10.2024 (Annexure P-7), which has not been decided by the respondent as yet.

At this stage, learned counsel for the petitioner submits that the petitioner be permitted to file a fresh comprehensive representation to the respondent, whereafter, the respondent/competent authority be directed

to decide the said representation within a time bound schedule. Learned counsel appearing for the respondent is not averse to this prayer.

Looking to the limited grievance of the petitioner, this writ petition is disposed of by permitting the petitioner to file a fresh comprehensive representation to the respondent/competent authority within a period of two weeks from today. In case such a representation is received by the respondent within two weeks as aforesaid, the same shall be considered and decided in accordance with law within a period of six weeks thereafter. The decision so arrived at shall also be communicated to the petitioner.
