This writ petition has been filed for the grant of

following reliefs:-

(i) That a writ in the nature of the Mandamus may kindly be issued by directing the respondent department to duly and promptly address the

observations made in the Annexure P-1 by the respondent Accountant General alongwith the consequential benefits.

(ii) That a further writ in the nature of Mandamus may kindly be issued to the respondent department to grant the said annual increment in favour of the petitioner and thereafter, the respondent Department may be directed to refix the pay of the petitioner in accordance with law.”

2. Learned Additional Advocate general has placed

on record a copy of instructions memo dated 19.08.2023. Para-7 whereof reads as under:-

“ 7. That the Govt. vide Notification No. FFE- A(B)6-3/2016 dated 20.09.2017 has regularized the adhoc promotion of the petitioner which was received in the office of Respondent No.4 from the Respondent No.3 on dated 20.01.2023, on that basis, Respondent No. 4 vide letter No. 9903 dated 06.02.2023 has asked to the petitioner to submit the option under FR-22 for fixation of pay. The petitioner has submitted the option under FR-22 on dated 03.03.2023, which was received in the office of Respondent No.4 on dated 10.03.202. The pay of the petitioner as per FR-22 has been prepared and submitted for vetting by giving one increment on lower post and further the pay has been fixed in the higher pay scale by granting one additional increment from the date of promotion i.e. from 20.09.2017 and the case has been submitted to the office of Respondent No.3 vide Respondent No.4 memo No.11494 dated 22.03.2023. The Respondent No.3 has further submitted the case for examining/vetting to the Respondent No.5 vide letter No.

12197 dated 31.03.2023. Further Respondent No.2 has vetted the proposal of pay fixation vide office order No. 324/2023 (E-II) dated 03.05.2023 which was received in the office of Respondent No.4 through Respondent No.3 on 09.05.2023. Respondent No.4 has issued the pay fixation order vide order No. 71/2023-24 dated 01.06.2023 and the revised calculation sheet of pension has also been submitted to the Respondent No.5 vide letter No. 2160 dated 24.06.2023. Respondent No.5 has been sanctioned the revised DCRG vide his letter No. PEN3/2062217368/ 7/ P/ 23/ 4-5/602861 dated 27.07.2023 ant Respondent No. 4 has also order to release the balance amount of DCRG in favour of the petitioner vide office order No. 190/2023-24 dated 18.08.2023 (Annexure R-I) after deducting the Govt. dues if any as mentioned in para No. 5.”

3. Learned counsel for the petitioner fairly admits

that in view of above, relief prayed by the petitioner stands granted to him.

4. Since, relief prayed for by the petitioner now stands granted to him by the respondents, the present petition to stand disposed of.
