This writ petition has been filed for the grant of

following substantive reliefs:-

“(i) That the instant writ petition may kindly be allowed with cost and the respondents may kindly be directed to grant the benefit of past approved military services in the shape of increments @ 3% (Annexure P-4) by fixing the basic pay of the petitioner;

(ii) Issue direction to the respondents to release the arrears on increment along with interest @ 9 percent P.A. from the date of accrual till the actual date of fixation of the pay with 3% increment to the petitioner as highlighted in relief clause No.(i) above.”

instructions memo dated 06.09.2023, issued from the Directorate of Industries, Himachal Pradesh. The instructions, inter-alia, state that the issue with regard to grant of benefit of past military services by fixing the basic pay of the petitioner was examined by the respondents in consultation with the Finance and Personnel Departments. Pursuant to the advice tendered by the said departments, the respondents have extended the benefit of past military services by fixing the basic pay of the petitioner vide office order dated 04.09.2023. A copy of office order dated 04.09.2023 has also been appended alongwith the instructions.

Since the relief prayed for by the petitioner now stands granted to him, this writ petition to stand disposed of. Needless to observe that all consequential actions in terms of office order dated 04.09.2023 shall follow. The benefits due to the petitioner in terms of the aforesaid office order be released in his favour within six weeks from today. Pending miscellaneous application(s), if any, also stand disposed of.
