Mr.J.K. Verma, learned Deputy Advocate General, has placed on record instructions dated 30th August, 2017, which read as under:
“I have the honour to submit that the above titled case is pending adjudication before the Hon’ble High Court of H.P. and was listed in the Hon’ble Court on 20.07.2017, when the Hon’ble Court was pleaded to grant four weeks time to do the needful in compliance of judgement dated 29.10.2013 passed in CWP No.8562 of 2013 titled as Shri Ram Dass and others v/s State of H.P. & others.

In this regard it is submitted that as per judgment/directions of the Hon’ble High Court dated 29.10.2013 passed in CWP No.8562/2013, the benefit of seniority has been granted to all the petitioners from the date of their initial appointment as Un-trained JBT teachers and also given promotional benefit on notional basis as Head Teacher & Centre Head vide office order No.EDNBLS(Ele)(E-IV)(promotion)(court case)2013-4293543053 dated 22.10.2014 and office order No.EDNBLS(Ele)(E-IV)(Promotion)(Court case)-2013-45104207 dated 20.11.2014. The pay fixation due to promotion as Head Teachers and Centre Head Teachers on notional basis has also been made in respect of all the petitioners.
It is further submitted that out of four petitioners, three eligible petitioners i.e. 1, 2 & 4 have been promoted as Block Elementary Education Officers (on notional basis) from the date their juniors were promoted as BEEO’s, vide this office order No.EDN-H(Ele-IV)B(6)-3-7/2015Untrained Promotion, Shimla, dated 09.09.2016. Moreover, revised pension case of petitioner No.1, Shri Ram Dass has been approved by the Govt. and has been sent to the Accountant General, H.P. vide letter No.EDN-BLS-Elem.(E-II) pension Case23/2012-22824 dated 29.08.2017, however, the pension case of petitioner No.2 & 4, Shri Hari Ram & Shri Lekh Ram, respectively, has been sent to the Govt. for clarification, as and when the matter is received from the Govt. the same shall be sent to the Accountant General, H.P. Since, the pension

case of petitioner No.3, Shri Ajeet Singh, Retired CHT has already been settled.
It is, therefore requested that the Hon’ble High Court may kindly be apprised accordingly please.”
Accordingly, the present petition stands disposed of as withdrawn, so also pending application(s), if any.
