The parties are ad idem that they, in principal, have finally

settled the matter before the learned Mediator, in terms whereof it has been agreed:-

That the petitioner shall handover the peaceful and vacant possession to the respondent-landlord on or before 28.2.2018. However, this shall be subject to the payment of ` 1,85,000/- by the respondentlandlord to the petitioner on or before 25.2.2018, as agreed to by the parties.

That the amount of ` 1,85,000/- shall be deposited by the respondent-landlord in the bank account of the petitioner, to be furnished by him within two weeks.

That the parties shall have no other claim against each other.

1. The statements of the parties recorded by the learned Mediator and the order so passed on the basis of such statements shall form part and parcel of this order.

In addition to the aforesaid, I have been informed at the Bar that the respondent-landlord has filed a petition for eviction on the ground of arrears of rent, he however undertakes not to press the same. Accordingly, the said petition is deemed to be dismissed on production of the copy of this order by either of the parties.

The undertaking of the respective parties before the learned Mediator is accepted by the Court and shall be read as part and parcel of this order.

The eviction petition is allowed in the aforesaid terms, leaving the parties to bear their own cost.
