[1] Mr.S.S.Vayeda, learned advocate for Mr.Dhruv Dave, learned advocate appearing on behalf of the applicant submits that the learned trial Court has wrongly appreciated the complaint to prove the legal debts and liabilities where the issue has been raised that the signed cheque has been misused since it was given for remitting the shares. He further submits that had it been cancelled, certainly, an endorsement of cancelled cheque would be reflected on the cheque itself.
