After arguing the case for some time, Shri Viral K. Shah, learned advocate for the appellant seeks permission to withdraw this appeal keeping all the contentions raised herein and even in Civil Application reserved for final hearing of writ petition being Special Civil Application No17459/2005.
Considering that the Special Civil Application is of year 2005, learned Single Judge may give due priority and hear the same. Letters Patent Appeal is disposed of.
It is made clear that we have not entered into the merits of any of the contentions in view of request made by learned counsel for the appellant-petitioner to withdraw this appeal.
