Heard Mr. N. Borah, the learned counsel for the accused/applicant. Also heard Mr. K. K. Das, the learned Additional Public Prosecutor, Assam.

This petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the accused/applicant, namely, Ajoy Singha has prayed for granting pre-arrest bail, apprehending arrest in connection with Helem P.S. Case No. 51/2025, under Sections 318(4)/316(2)/351(2) of BNS, 2023 .

The gist of accusation against the accused/applicant is that he had taken the complainants vehicle bearing registration No. AS01MC6251 (Dumber) on a monthly rent basis of Rs.1,30,000/- per month by signing an agreement. But he has paid only, 2,00,000/- and the arrear amount of Rs.12,00,000/- is still pending and when the complainant approached the accused person and demanded the money he allegedly threatened him.

It may be mentioned that by order, dated 31.07.2025, this Court granted the privilege of interim pre-arrest bail to the accused/applicant subject to conditions.

Mr. N. Borah, the learned counsel for the accused/applicant submits that the accused/applicant appeared before the investigating officer and got his statement recorded under Section 161 Cr.P.C. in terms of the interim pre-arrest bail granted earlier.

Mr. K. K. Das, the learned Additional Public Prosecutor, Assam objects the prayer for bail and submitted that case diary may be called for.

Having heard the learned counsel for the parties and considering the nature of allegation, this Court finds that custodial interrogation of the accused/applicant may not be necessary in the interest of the ongoing investigation into the case.

Accordingly, the interim pre-arrest bail granted vide order, dated 31.07.2025 is hereby made absolute, subject to the said conditions.

This disposes off the anticipatory bail application.
