Heard Mr. B. J. Mukherjee, learned counsel for the petitioner. Also heard Mr. V. K. Baruah, learned counsel appearing for the respondents no. 3 to 5.

In view of the agreement arrived at by and between the parties in the matter, no detail order is called for to be passed.

It is only required to be recorded that the learned counsel for the SBI, Mr. V. K. Baruah has submitted that the pension and pensionary benefits as due to the petitioner is being released to her on time as per the rate as admissible in the matter.

The learned counsel for the petitioner Mr. B. J. Mukherjee also does not dispute the receipt of such amount by the petitioner.

Mr. V. K. Baruah, learned counsel for the SBI has further submitted that on account of an error occasioning on the part of the Bank authorities, the petitioner, at a particular point of time was being authorized pension at a higher rate and there was a recovery required to be made. However, it is

undertaken that no such recovery would be effected from the pension and pensionary benefits of the petitioner.

In that view of the matter, Mr. B. J. Mukherjee, learned counsel for the petitioner submits that he would have no grievance left in the matter and this Court would be pleased to close the present writ petition.

By noting the undertaking given by Mr. V. K. Baruah, learned counsel for the SBI in the matter that there would be no recovery effected from the pension and pensionary benefits of the petitioner and as that the petitioner’s pension has been regularized and she is receiving her dues at the appropriate time, this Court holds that no further issue arises for adjudication in the matter and accordingly, the writ petition stands disposed of in terms of the above.
