None appears for the petitioner on call.
Ms. B. Baniya, learned counsel for the respondent no.1 and she submits that order of this Court has already been complied with.
On 09.04.2024 the Court passed the following order :
“None appears on call for the petitioner.
Mr. S.K. Talukdar, learned counsel for the respondent no.1 has submitted that this matter has become infructuous. In this regard, he has submitted that the order of this Court dated 23.09.2021 passed in WP(C) 4717/2021 have been upheld, pursuant to which, the Addl. Registrar of Cooperative Societies, Kokrajhar had passed an order dated 18.03.2023.
It is submitted that parallel to this contempt petition, another five writ petitions were filed from time to time challenging the order dated 18.03.2023. However, the said orders have been upheld in those writ petitions. It is submitted that the petitioners in this contempt petition has accepted the said order and pursuant to the disposal of those five writ petitions, elections have been held in all the five Cooperative Societies, which were taken over by One Man Committee. Hence, it is submitted that the cause of action for contempt does not survives. Be that as it may, as the petitioner is found absent on call, the matter stands adjourned today as a last chance. It is made clear that if the petitioner remains absent on call on the next date, adverse orders would be passed .
List after ensuing Bihu vacation”
