The prayer made in this writ petition is, in essence, for issuance for a direction for
restructuring the pay of the petitioners as per recommendation of the 5th Central Pay Commission.
Mr. K. Gogoi, learned CGC appearing for the respondent submits that this writ petition was instituted in the year 2011 when the age of the petitioner was 56 years and therefore, it is evident that he has in the meantime, retired from service. Moreover, by referring to the paragraph 7 of the counter affidavit filed by the respondent, Mr. Gogoi submits that the grievance of the petitioner has already been redressed.
Be that as it may, since the petitioner’s counsel has remained absent on two consecutive occasions, it appears that the petitioner is no longer interested to pursue this matter any further before this Court. As such, this matter stands dismissed for nonprosecution.
