Heard Mr. R. Mazumdar, learned counsel for the petitioner and Mr. M. Chetia, leaned govt. advocate for the respondents.

The bid of the petitioner in respect of NIT dated 23.09.2022 for settlement of 58 No. Akra Beel Fishery, Barpeta was not brought to its logical conclusion on the grounds that amongst two bidders, one cannot be selected. The said order was passed by the Joint Secretary to the Govt. of Assam, Fishery Department.

The learned Govt. advocate has produced a copy of letter dated 02.06.2023 by the Joint Secretary to the Govt. of Assam, Fishery Department.

Accordingly, it appears that there were three numbers of successful bidders and the Deputy Commissioner, Barpeta was directed to send the minutes of Tender Committee meeting for the regular settlement of the said Beel. Under such circumstances, the Court is of the considered opinion that as the

competent authorities are taking up the matter for settlement of aforesaid Beel, this matter has become infructuous and accordingly, this writ petition stands closed with liberty to the competent authorities to bring the settlement of said Beel to its logical conclusion.
