However, heard Mr. R. Dhar, learned standing counsel, Department for Welfare of Plain Tribes & Backward Classes, Government of Assam; Mr. P. Nayak, learned standing counsel, Finance Department, Government of Assam; Mr. G. Pegu, learned Addl. Senior Government Advocate, Government of Assam; and Mr. S. Islam, learned counsel; appearing on behalf of their respective respondents.
This writ petition under Article 226 of the Constitution of India, has been filed by the petitioners, for payment of monthly salaries for the services they have rendered in the Barak Valley (Hills Tribes) Development Council[BVHTDC].
It appears that the petitioners are LDAs, Grade-IV and Peon, appointed by the Chairman, Barak Valley (Hills Tribes) Development Council[BVHTDC], in the year 1996, vide Annexure-3 series to this writ petition.

On perusal of the orders of the appointment of the petitioners which have been annexed as Annexure-3 series to the writ petition, it is noticed that though they have been appointed as LDAs, Grade-IV and Peon, no documents showing thier pay scale/salaries or otherwise fixed by the Barak Valley (Hills Tribes) Development Council[BVHTDC], have been annexed by the petitioners in this writ petition.
Since a similar writ petition being WP(c)3658/2015, has been adjudicated by this Court today wherein it has been held that neither, the Barak Valley (Hills Tribes) Development Council[BVHTDC] is an independent legal entity, nor, the Barak Valley (Hills Tribes) Development Council[BVHTDC] has any sanctioned posts such as UDAs, LDAs, Peon and Driver, where such appointments could have been made; this writ petition also stands dismissed being devoid of merit with a liberty granted to the petitioners to approach the appropriate authorities and/or file a Civil Suit before the competent Court for payment of the salaries/wages they have rendered in the Barak Valley Hill Tribes Development Council(BVHTDC), if they are entitled to.
