Heard Mr. S. K. Sarkar, learned counsel for the petitioner. Also heard Mr. P. Saikia, learned Government Advocate for the respondent No.1 & 4 and Mr. P. K. Bora, learned Standing Counsel for the Elementary Education Department, representing respondents No.2 & 3.

The father of the petitioner, who died in harness on 04.07.2013 while serving as Assistant Teacher in Kanaijan L.P. School, Lakhimpur has filed this writ petition, seeking appointment on compassionate ground.

Mr. Saikia, learned Government Advocate representing respondents No.1 and 4 submits that he has received instruction from the respondent No.4, the Deputy Commissioner cum Chairman District Level Selection Committee, Lakhimpur, stating that the case of the petitioner for compassionate appointment was considered by the authorities on 3(three) occasions and the appointment of the petitioner on compassionate ground could not be made due to non-availability of required vacant post.

Under the circumstances, Mr. Sarkar, learned counsel for the petitioner has submitted that this writ petition may be disposed of with a direction to the respondent authorities to consider the case of the petitioner as and when the vacant post for compassionate appointment would be available.

Upon hearing the learned counsels appearing for the parties, I deem it appropriate to dispose of this writ petition with a direction to the respondent

authorities to consider the case of the petitioner for compassionate appointment, if the same is permissible under the extant scheme of compassionate appointment followed by the Government of Assam.

Accordingly, this writ petition is disposed of with a direction to the respondent authorities to consider the case of the petitioner for appointment on compassionate basis, if it is permissible under the extant scheme of policy adopted for compassionate appointment by the Government of Assam.

The writ petition stands disposed of, with the above direction.
