This is an appeal filed by the claimant against the judgment and order dated 30.04.2013 passed by the learned Motor Accidents Claims Tribunal, Morigaon, (hereinafter referred to as “Tribunal”), in MAC Case No. 142/2008.
The Reliance General Insurance Company Limited (for short Insurance Company) is represented by Shri Ravi Sharma, Associate Legal Claims Manager.
The claimant is represented by Shri M. Talukdar, the learned counsel.
The parties present before this Court jointly submit that the awarded amount of Rs. 1,11,176/- (Rupees One Lakh Eleven Thousand One Hundred Seventy Six) has already been paid and received by the claimant. Further, the parties have reached an out of Court settlement for additional amount of Rs. 3,00,000/- (Rupees Three Lakhs) which is a full and final settlement to be paid by the Insurance Company.
In view of the above, the appeal stands closed with a direction that the Insurance Company shall now deposit the additional amount of Rs.3,00,000/- (Rupees Three Lakhs) being the full and final settlement before the learned MACT, Morigaon within a period of 45 days from today. The said amount would be released to the claimant on being properly identified by the learned counsel for the claimant. In this regard, the application filed by the claimant is made part of the records.
A memo of settlement is made a part of the record.
The MAC Appeal stands disposed of.
