Heard Mr. G. Taloh, learned counsel for the petitioner alongwith Ms. T. Jini, learned Additional Public Prosecutor representing the State respondent.
Mr. Taloh, learned counsel for the accused petitioner submits that though the order dated 15.07.2022 had listed the matter for 08.08.2022, inadvertently, this matter was listed today i.e. 18.07.2022.

Ms. Jini, learned Additional Public Prosecutor, on the other hand submits that the Case Diary is not available today, since as per the order dated 15.07.2022, the Case Dairy was to be produced on 08.08.2022.
Having heard both the parties the Court does not find appropriate to take up the matter today.
In view of the order dated 15.07.2022, Mr. Taloh, learned accused petitioner submits that, if this matter cannot be heard today, he may be allowed to withdraw the Bail Application as with regard to the accused petitioner, who was arrested on 03.06.2022, and has been in custody eversince.
Having heard the submission made, considering the fact that the Case Dairy itself is not available in the Court today. The Court finds it fit to allow the accused petitioner to withdraw the Bail Application submitted, and accordingly, BA 59(AP)/2022, stands disposed on withdrawal of the petitioner.
