3. Facts of the case as submitted by the learned counsel for the petitioner in brief is that on 04.11.2021, the accused/applicant had accompanied his friends to the rental house of Smti. Yami Komi Nyogen. It was on the eve of the Diwali so they had some drinks and while in the house of Smti. Yami Komi Nyogen, another group compromising of John Tapin and his friends were having drinks in the adjacent room of the rental house. Thereafter, at around 10:00 p.m. the John Tapin and his friends joined the accused/applicant and his friends. While they were playing ‘Tambola’, John Tapin got offended when the accused/appellant teased him, saying that he was not a real Bokarand an altercation erupted between the two which escalated into physical confrontation, wherein the accused/applicant being well built physically dominated and overpowered John Tapin. John Tapin then called his other friends who were also celebrating Diwalai nearby and at the instigation of John Tapin, they started beating the accused/appellant and his 2 (two) other friends who were with him. The accused/appellant then tried to run away from the scene, however, the deceased Khyoda Tama chased him and his friends.
