This is an application filed under Section 438 of the CrPC seeking pre-arrest bail in connection with North Guwahati PS Case No. 45/2022 registered under Section 498A of the IPC.

Ms. A. Das, learned counsel for the petitioners submits that while calling for the Case Diary, an interim order was passed which is continuing till date.

Shri P. Borthakrur, learned Additional Public Prosecutor, Assam however submits that investigation is over and the charge sheet has been submitted on 30.05.2022 with CS No. 24/2022.

In view of the changed circumstances, the learned counsel for the petitioners seeks liberty to approach the learned Trial Court with a prayer for regular bail.

The petitioners may accordingly approach the learned Trial Court within a period of ten days from today and till such date, the interim protection granted earlier still continue. On such approach, the petition for bail may be considered strictly as per merits.
