In pursuance of the Office Memorandum under No. ABP.6/2016/51 dated 02.09.2020, in the said advertisement dated 11.09.2020, it was also specified that the relaxation shall be applicable only to those candidates who have attained necessary educational or other qualifications prior to crossing of their existing upper age limit of 40 years. As per the said advertisement, applications have to be submitted through online process. Though the petitioner applied through the online mode, but it was not accepted by the receiver as she was overaged, as such, petitioner on 23.09.2020 submitted representation before the Commissioner and Secretary to the Government of Assam in the Elementary Education Department as well as the Director of Elementary Education, Assam, respondent Nos. 1 & 3 respectively, requesting the authorities to relax her upper age, enabling her to participate in the selection process by accepting her application in pursuance of the advertisement dated 11.09.2020 of the DEE, Assam. As her application for condonation/relaxation of her upper age, has not been considered by the authorities in the Elementary Education Department, Assam, petitioner has preferred this writ petition.
