The dispute raised in the present writ petition is a limited one. The writ petition has been instituted by 28 numbers of villagers who are aggrieved by the inaction of the authorities in disbursing the entire amount of compensation for the land acquired. It is the case of the petitioners that 80% of the compensation which has been assessed has already been paid to the petitioners as well as the two individuals who are brothers and in dispute and it is because of the dispute between the two brothers that the entire disbursement has came to a halt.

Sri B. Picha, learned counsel for the petitioners submits that because of the dispute between the two individuals the entire villagers should not suffer any prejudice.

Sri Y. Riram, learned State Counsel submits that till the entitlement of the two brothers are not resolved, a suitable direction may given to the Deputy Commissioner, Upper Subansiri to release the remaining 20% without causing prejudice to the two individuals who are in dispute regarding a portion of the compensation entitled to by them.

After considering the submissions, this Court is of the view that present writ petition is not require to be detained any further. It is accordingly, directed that the Deputy Commissioner, Upper Subansiri will undertake an exercise regarding the total amount which should be entitled to by the two individuals

(brothers) who are in dispute regarding a portion and by keeping such amount intact, release the rest of the amount to the petitioners and the others villagers in accordance with law. It is needless to say that after the resolution of the dispute between the two individuals, their respective shares may paid from the amount kept intact and if any further balance remains, the same should be distributed amongst the petitioners and other villagers on approval of the authorities.

Writ petition accordingly, stands disposed of.
